CANCELLATION, RETURN AND REFUND POLICY
These terms and conditions apply to sales made by Médequip for business customers (B2B).
1. Products manufactured and configured to order
The tables sold by Médequip are manufactured and/or configured specifically to the Customer’s requirements, in accordance with the specifications selected and confirmed at the time of ordering.
These characteristics may include, in particular:
the table model; ;
the colour and type of surfacing; ;
the colour or finish of the frame; ;
dimensions or technical specifications; ;
the headrests; ;
drop systems; ;
lifting or adjustment systems; ;
accessories and options; ;
as well as any other features chosen by the Customer.
The manufacture and/or supply of the product is undertaken on the basis of this individual configuration.
Consequently, Any order confirmed by the Customer is binding and final, subject to any mandatory legal provisions that may apply.
2. Configuration validation
It is the Customer’s responsibility to check carefully, before confirming the order, all the details set out in the quotation or purchase order.
The signing of the quotation, the electronic confirmation of the order, the payment of the deposit or any other action that unambiguously indicates acceptance of the order shall constitute the Customer’s confirmation of the product configuration.
In particular, the Customer is required to check the model, options, finish, colours, accessories and any specific technical features selected.
Any changes requested after the order has been confirmed are subject to Médequip’s prior approval and to the manufacturer being technically able to amend the order.
This may result in a change to the price and/or delivery time.
3. Cancellation after the order has been confirmed
Given the specific nature of the products and the fact that they are manufactured or configured to order, No cancellation on the Customer’s own initiative may be requested once the order has been confirmed.
Médequip may, however, in exceptional circumstances and at its sole discretion, accept a request for cancellation where the manufacture or preparation of the order still allows for such a change.
In this case, any costs already incurred by Médequip – in particular those payable to the manufacturer, the carrier or its service providers – may remain the responsibility of the Client.
Any exceptional acceptance of a cancellation must be subject to Médequip’s written consent.
4. No returns or exchanges for personal convenience
Due to their specific manufacture and/or configuration, the tables ordered by the Customer are neither returned nor exchanged after manufacture or delivery on the grounds of personal preference.
In particular, returns are excluded where they are due to:
a change of mind; ;
an error on the part of the Customer in choosing the model; ;
an error in the choice of colour or finish; ;
an error in the choice of options or accessories; ;
a discrepancy with the Customer’s personal preferences; ;
any subsequent change in its requirements; ;
difficulty accessing the premises which had not been reported prior to the order.
This provision does not affect the Customer’s rights in the event of a defect, non-conformity with the order, an error attributable to Médequip or the invocation of an applicable warranty.
5. Right of withdrawal
Sales made by Médequip are intended for business customers and, in principle, are not subject to the right of withdrawal available to consumers, subject to any mandatory legal provisions that may apply to certain business-to-business relationships.
Furthermore, even where the legal conditions for a right of withdrawal are met, this right may, in particular, be excluded in the case of goods made to the Customer’s specifications or which are clearly personalised, in accordance with the conditions laid down by the applicable legislation.
Tables manufactured and configured according to the Customer’s individual preferences may fall into this category.
6. Product as ordered
Minor differences in colour, texture, grain, finish or appearance that may result from the materials used, manufacturing processes or the representation of colours on a screen or in print do not, in themselves, constitute grounds for a return or cancellation provided that they do not affect the essential characteristics of the product ordered.
The photographs, colour charts and illustrations available on Médequip’s website, in its catalogues or in other materials are provided for illustrative purposes only.
7. Checking on delivery
The Customer must check the external condition of the product and its packaging upon delivery.
In the event of apparent damage caused during transport, the Customer must make a note on the transport document precise, detailed and comprehensive reservations, describing the nature of the damage observed.
The Customer is also asked to:
take a photograph of the packaging before opening it; ;
take photographs of any damage; ;
take a photograph of the product after unpacking it; ;
keep all packaging and protective materials; ;
Please inform Médequip as soon as possible.
General clauses such as «subject to unpacking» do not, on their own, describe the nature of any damage.
8. Configuration error attributable to Médequip
If the product delivered does not correspond to the specification expressly confirmed on the quotation or purchase order due to an error attributable to Médequip, the Customer must inform Médequip as soon as possible.
The application must be accompanied by evidence enabling the error to be identified and verified, in particular:
quote or invoice number; ;
table serial number; ;
photographs; ;
a description of the difference observed.
Following verification, Médequip will work with the Client to determine the appropriate solution, taking into account the nature of the error identified.
9. Fault or malfunction
The discovery of a fault or malfunction does not automatically entitle the customer to a replacement or a refund for the table.
The Customer must contact Médequip in advance so that the cause of the problem can be identified and the relevant warranty procedure can be initiated.
In particular, Médequip may request:
the table’s serial number; ;
a detailed description of the problem; ;
photographs; ;
videos; ;
carrying out simple tests to establish a diagnosis.
Depending on the nature of the problem and the applicable warranty terms, a solution may take the form of, for example, a diagnosis, the dispatch of a part, a repair, a technical service call or, where justified, a replacement.
10. Returns authorised by Médequip
Where a return is necessary due to a fault, an incorrect delivery, a warranty claim, or where it is exceptionally accepted by Médequip, No goods may be dispatched without Médequip’s prior written consent.
Médequip will provide the Customer with the return instructions and the address to which the item should be sent.
Any return made unilaterally by the Customer without prior authorisation may be refused.
11. Costs and risks associated with the return
Where the return is due to an error on the part of Médequip or is covered under an applicable warranty, the arrangements for transport and the allocation of costs will be determined in accordance with the terms of the relevant warranty.
Where, in exceptional circumstances, a return is accepted for a reason not attributable to Médequip, all costs relating to transport, handling, packaging, insurance, repackaging and restocking may be charged to the Customer, following notification to the Customer.
Given the weight and size of the tables, the Customer must not arrange for their return transport without first receiving instructions from Médequip.
12. Warranty and hidden defects
These provisions relating to the exclusion of returns for personal convenience do not preclude the mandatory statutory guarantees, in particular the guarantee against hidden defects set out in Articles 1641 et seq. of the Civil Code, nor any contractual guarantees or manufacturer’s guarantees applicable to the product.
13. General principle
The manufacture of a table commences on the basis of the configuration expressly chosen and approved by the Customer.
The Customer is therefore advised to check their entire configuration carefully before confirming their quote.
Once the order has been confirmed and placed with the manufacturer, any amendment, cancellation, return or exchange remains subject to these terms and conditions and, where it does not result from a fault or error attributable to Médequip, to Médequip’s prior written consent.
